Ordinance No. 2024-55 Creating the Orlando Sports and Entertainment Community Development District (SED CDD) (Growth Management Plan (GMP) 2024-10022) (Economic Development)

Summary:

Proposed Ordinance No. 2024-55 would create a new community development district, named the Orlando Sports and Entertainment Community Development District (SED CDD) (the District), consisting of approximately 8.424 acres and designating five people to serve as the initial board of supervisors. The District is generally located between W. Central Boulevard and W. Church Street, and between South Hughey Avenue and South Division Avenue.

The District is a "Community Development District" (CDD), a special-purpose unit of local government that plans, finances, constructs, and maintains public infrastructure such as roads, stormwater utilities, landscaping, and other common facilities. CDDs are typically created by the applicable City or County government but are governed by a board of supervisors elected by property owners in the CDD.

The creation of the Orlando SED Community Development District is requested by Orlando SED Partners, LLC (the Petitioner), and the Petitioner has obtained written consent to establish the District from the owners of one hundred percent (100%) of the real property located within the proposed District, in accordance with Section 190.005, Florida Statutes. The Petitioner filed its request on October 29, 2024.

In making its determination to grant or deny the petition, the Orlando City Council must consider the testimony and evidence provided at a public hearing and the following factors found in Section 190.005(1)(e), Florida Statutes:

  • Whether all statements contained within the petition have been found to be true and correct
  • Whether the establishment of the District is inconsistent with any applicable element or portion of the state comprehensive plan or of the effective local government comprehensive plan
  • Whether the area of land within the proposed new district boundaries is of sufficient size, is sufficiently compact, and is sufficiently contiguous to be developable as one functional interrelated community
  • Whether the District is the best alternative available for delivering community development services and facilities to the area that will be served by the District
  • Whether the community development services and facilities of the District will be compatible with the capacity and uses of existing local and regional community development services and facilities
  • Whether the area that will be served by the District is amenable to separate special district government

City Staff has reviewed the Petition and recommends that City Council find, based on the record evidence, that the Petition meets the statutory standards of review. The Petition provided by the Petitioner is attached to this Council Agenda Item as part of the record.

Recommended Action:

Approving Ordinance No. 2024-55 on first reading and authorizing Mayor and City Clerk to bring the Ordinance forward at the next available City Council Meeting for second reading, hearing and adoption.
