| Subject: | Ordinance No. 2020-55 Granting Electric Utility Franchise Agreement for Duke Energy |
| Summary: | Duke Energy has electric utility facilities within the City of Orlando rights of way, which are governed by a non-exclusive electric utility franchise agreement. The franchise area includes those areas within the City limits for which Duke provides electric utility service. Duke Energy and City staff have negotiated a new franchise agreement for the non-exclusive use of the City’s rights-of-way, including a franchise fee amount equal to 6% of from the sale of electricity within the corporate limits of the City. The term of the non-exclusive franchise is ten (10) years, through 2030. The franchise agreement includes construction standards and specifications for the system in the City’s rights of way and insurance and indemnification requirements are imposed. |
| Fiscal and Efficiency Data: | The City will continue to receive franchise fee revenue for the use of the City’s rights-of-way. |
| Recommended Action: | Adopting Ordinance No. 2020-55 and authorizing the Mayor and City Clerk to execute the same, after review and approval by the City Attorney's Office. |
