Confirmatory Assignment of Rights and Obligations under Utility Easement between Meritage Homes of Florida, Inc., Orlando Utilities Commission and City of Orlando

In 2012, the City of Orlando, "City", and the Greater Orlando Aviation Authority, conveyed a utility easement (over OIA property) to Meritage Homes of  Florida, Inc., "Meritage", providing for Meritage's installation of water and sewer lines in conjunction with the residential development of adjacent property. The utility easement also provided that Meritage could assign its interests in the easement to the Orlando Utilities Commission, "OUC", with respect to the water lines, and Orange County with respect to the sewer lines. Meritage has previously assigned its interest in the sewer lines to Orange County and now desires to assign its interest in the water line to OUC. OUC has inspected and is willing to accept the water lines for ownership/maintenance. The City is executing the attached Assignment solely as an owner of the easement for the benefit for OUC and, otherwise, has no responsibility or liability related to the Assignment.

Fiscal & Efficiency Data: No fiscal impact. 

Recommended Action:
Approving Confirmatory Assignment of Rights and Obligations and authorizing for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
