Landscape Construction and Maintenance Memorandum of Agreement between the Florida Department of Transportation and the City of Orlando for 1101 S. Orange Ave

Summary:

The Owner of property located at 1101 S. Orange Ave., "Property", is installing certain landscaping improvements within right-of-way owned by the Florida Department of Transportation, "FDOT.”  The improvements are being installed in conjunction with Owner's development of the Property.  In order to allow Owner's installation of the improvements within FDOT right-of-way, FDOT requires that the City enter into the attached Agreement relating to installation/maintenance of the improvements.  However, concurrently with approval of the attached Agreement, the City is entering into an agreement with the Owner, whereby the Owner will assume all obligations related to installation/maintenance of the improvements.

Recommended Action:

Approval of the attached Agreement and Resolution and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
