On March 14, 2018, XSC Acquisitions, LLC (the "Applicant") applied to the City of Orlando for approval of a three-phase, three tower development that would include 889 units and a multi-family complex with up to 120,000 square feet of commercial space on approximately 3.57 acres of land generally located at the corner of West Livingston Street and North Orange Avenue. The Applicant also requested approval of a density bonus. (the " Golden Sparrow Project").
On January 14, 2019, the Orlando City Council approved the framework Master Plan for the Golden Sparrow Project. On August 30, 2018, the City of Orlando Appearance Review Board, (the "ARB") recommended approval of the Applicant's first application requesting Major Certificate Appearance Approval for Phase 1 of the Golden Sparrow Project (the "ARB 1 Application"). The Orlando City Council approved the ARB 1 Application on January 14, 2019.
On October 12, 2018, the Applicant submitted a second application requesting Major Certificate Appearance Approval for Phases 2 and 3 of the Golden Sparrow Project. (the "ARB 2 Application"). The ARB recommended approval of the ARB 2 Application on November 15, 2018.
The Petitioner timely filed a Request for a Hearing before a Hearing Officer pursuant to Article XXXII, Chapter 2, Orlando City Code. Subsequent to filing the request, the parties negotiated the attached settlement stipulation and offer it to Council for final approval pursuant to section 2.210, Orlando City Code.
The proposed Stipulated Land Development Order approves ARB application case number ARB2018-10011, subject to the conditions of approval contained in the ARB minutes of November 15, 2018, as amended as follows and the additional conditions set forth as follows:
1. The Applicant has agreed to withdraw its request for a Green Wall System and to submit final facade treatment for approval by the City Planning Official prior to applying for building permits.
2. Phase 2 of the Golden Sparrow Project will be increased by two floors and Phase 3 will be reduced by three floors.
3. The City Planning Official approves the Administrative Plans for Phases 2 & 3 of the Golden Sparrow Project (MPL2019-10016).
