Reclaimed Water Reimbursement Agreement between Greater Orlando Aviation Authority and All Aboard Florida-Operations, LLC

Summary:

On January 22, 2014, the City, GOAA and All Aboard Florida-Operations, LLC, "AAF," entered into a Rail Line Easement Agreement providing for AAF's construction and operation of a passenger rail system terminating at the Orlando International Airport site, "OIA."  In conjunction with development of the rail system, AAF is installing landscaping along the rail corridor through OIA.  GOAA purchases reclaimed water from the City to irrigate portions of OIA and AAF has requested that GOAA provide the irrigation for its landscaping.  Under the terms of the attached Agreement, AAF will reimburse GOAA for the cost of reclaimed water utilized by AAF.  The City is executing a Joinder to the attached Agreement solely to acknowledge its consent as provider of the reclaimed water and owner of the property on which the Orlando International Airport is located.

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
