Mitigation Credit Purchase and Escrow Agreement between Wekiva River Mitigation Bank, LLC and City of Orlando

Summary:

The City of Orlando is currently permitting a drainage system and transportation improvements, "Improvements," through the St. Johns River Water Management District pursuant to its obligation under the Community Infrastructure Agreement entered into between Dr. Phillips, Inc. and the City of Orlando on December 12, 2017.  As a condition of permit issuance, the City must purchase mitigation credits to offset wetlands impacts, in the amount of $454,300.00.  The Improvements are being installed in conjunction with development of the Packing District, inclusive of the City Park Parcel.  


Fiscal & Efficiency Data:

Pursuant to the City's approval of the Community Infrastructure Agreement, referenced above and the Grant Agreement entered into between the City and Dr. Phillips, Inc., contemporaneously therewith, the funding sources for the public improvements will consist of a mix of capital improvement bonds, the City’s Stormwater Fund and various road construction funds. 


Recommended Action:

Approval of the attached Mitigation Credit Purchase and Escrow Agreement and authorization for the City's Public Works Director to execute same, subject to review and approval by the City Attorney's Office.
