Summary:
The applicant is requesting to rescind the Downtown Orlando Development of Regional Impact (DRI) Development Order pursuant to Section 380.115, Florida Statutes. The Downtown Development Board acts as the Master Developer for the Downtown DRI, the boundary of which is depicted on Exhibit A.
Recent changes in Florida's DRI laws, including the Community Renewal Act (Chapter 2009-96) and the Community Planning Act (Chapter 2011-139), have essentially eliminated DRI requirements for areas designated as "Dense Urban Land Areas" or "DULAs". The City of Orlando, in its entirety, qualifies as a DULA. As a result, no new DRIs have been established in the city. Further, several DRI Development Orders have been rescinded since that time including Orlando Health, Beltway Commerce Center, Orlando Corporate Center, MetroWest, and LeeVista.
On April 17, 2018, the Municipal Planning Board approved the rescission of the Downtown Orlando DRI Development Order (Case #DRI2018-10000). Florida law states that a Master Developer must have completed all mitigation tasks specified in the DRI concurrent with the current phase of said DRI. The applicant provided documentation that demonstrated that all required mitigation has been met, which is summarized in the staff report which includes the 2015-2017 Biennial Status Report for the Downtown DRI.
Concurrent with the approval of this rescission order, City Council is scheduled to adopt a series of Growth Management Plan amendments which memorialize certain aspects of the Downtown DRI within the GMP Future Land Use Element including the adoption of a new GMP Subarea Policy and Figure LU-2E "Downtown School Concurrency Exemption Area", all considered necessary to address the vested rights status of projects within the Downtown DRI area. Upon the effective date of the DRI rescission, each property within the Downtown DRI area will be governed by the Growth Management Plan, Future Land Use Map designations and Zoning classifications, as well as the requirements and entitlements specified in the Land Development Code. |
