Appeal of City Engineer Determination for Sidewalk Construction - 1131 Utah Boulevard

Summary:

Barbara A.  Branch and Darrell W. Smith, "Owners, own property located at 1131 Utah Boulevard, "Property."  In conjunction with Owners' proposed construction of a substantial improvement to the Property, City Code requires the construction of a sidewalk, "Sidewalk," along Utah Boulevard.  Pursuant to Section 61.225(B), City Code, the Owners requested that the City Engineer find that construction of the Sidewalk is not practical and that Owners be allowed to make payment to the City in Lieu of Construction.  After visiting the site and reviewing applicable criteria, the City Engineer determined that construction of the Sidewalk was feasible and not impractical and that, should the Owners proceed with their plans to construct improvements to the Property, they would be required to construct the Sidewalk as well.  On April 26, 2018 and pursuant to Section 161.225 (B)(3), the Owners appealed the determination of the City Engineer to this Council.
