Installation and Maintenance Agreement - Flag Pole at Harbor Park

Summary:

The attached Agreement authorizes Sentry Management (the managing agent for Baldwin Park Residential Owners Association, the “Committee”) to install a flag pole in Baldwin Park, on the west side of Lake Baldwin, on property owned by the City of Orlando, to celebrate patriotic events.

The Agreement provides a framework for the Committee to develop and submit to the City, for approval, designs for the flag pole, and to then construct and maintain it. The Committee will be responsible for all costs associated with permitting, installation of the flag pole, utilities, and on-going maintenance and repair of the flags, flag pole, cable, pulleys, lights, signage and so forth.  The Committee will also be responsible for providing the flags; raising/lowering the flags; and positioning flags at half-mast for required lengths of time.

Upon final acceptance, title to the flag pole shall pass from the Committee to, and vest in, the City. Provided that Committee is not in breach or default of the Agreement, the term of the License may be renewed for additional five year terms, with the Families Parks and Recreation Director authorized to execute such renewals, under the same terms and conditions, on behalf of the City without further approval from the Orlando City Council.

Recommended Action:
Approval and signature of the Installation/Maintenance Agreement at Harbor Park, and authorization for the Families Parks and Recreation Director to execute renewals, under the same terms and conditions, on behalf of the City, without further approval from the Orlando City Council.
