Subject:
Ordinance No. 2018-29 amending City Code Chapter 13, Building Code, to revise regulations for development within a floodplain. (Economic Development)

Summary:

The attached ordinance amends the Building Code to revise the requirements for development within a floodplain.  A companion ordinance (#2018-27) is proposed to amend the Land Development Code to address floodplains. After first reading, the ordinance was revised to update the definition of "substantial improvement" to match the Florida Building Code definition.

 

On December 20, 2017 Federal Emergency Management Agency (FEMA) issued a letter stating that the City must revise the floodplain code requirements by June 20, 2018 in order to maintain the City’s participation in the National Flood Insurance Program. FEMA provided a model ordinance that has been used to prepare the proposed revisions to City code.  The revisions will ensure that the City enforces floodplain development standards consistent with Federal requirements.

Recommended Action:

Adopt the attached ordinance number 2018-29 and authorize the Mayor and the City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
