Summary:
The City and County entered into a Mercy Drive Community Center Lease (Lease) dated December 3, 1991, as amended by the First Amendment, dated November 29, 2011, for the County’s lease from the City of approximately 6.63 acres of land for the construction and operation of a social services facility by the County named the Hal Marston Community Center (HMCC). The HMCC is located adjacent to and shares parking with the City’s Northwest Community Center. The term of the Lease expired on December 31, 2016, however, with the City’s permission the County has remained in possession of the premises and now desires to enter into a new lease for its continued occupancy and operation of the HMCC.
The term of the Lease shall be approximately ten (10) years commencing on the Effective Date of the Lease and end on December 31, 2028. The Term may, upon mutual agreement, be extended for two (2) additional terms of five (5) years each. Rent shall be one dollar ($1.00) per year and on a quarterly basis the County shall reimburse the City 40.5% of the costs incurred for its share of grounds maintenance |
Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Lease, substantially in the form attached, and authorization, without further City Council approval, for the Real Estate Division Manager to execute the renewal options provided therein, all subject to the review and approval of the City Attorney’s Office. |
