Ordinance No. 2018-13 abandoning a 0.39-acre part of North Rosalind Avenue generally located between Ridgewood Street and East Livingston Street and part of East Livingston Street generally located east of North Rosalind Avenue (Economic Development)
Summary:

The subject property, a ±0.39-ac. segment of City right-of-way, is that portion of North Rosalind Avenue located north of Ridgewood Street and south of East Livingston Street as well as a small portion of Right-of-Way (ROW) on the south side of East Livingston Street,directly to the east of North Rosalind Avenue.  This particular section of North Rosalind Avenue currently consists of a one-way, single-lane street.  The abandonment of this ROW will result in the removal of this street.

Upon abandonment, this ROW, along with the adjacent property to the east and west, is planned to be developed under the Rosalind and Livingston Residential PD (ZON2017-00014) which was heard and recommended for approval by the Municipal Planning Board (MPB) at the September 2017 MPB meeting.  Final abandonment of the ROW is predicated on the issuance of a site infrastructure and engineering permit for a residential project with at least 389 multifamily dwelling units to be constructed adjacent to the property.

Recommended Action:
Adopt the attached ordinance number 2018-13 and authorize the Mayor and City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
