First Amendment to Agreement between City of Orlando and Orange County for the Delivery and Use of Reclaimed Water for the Horizon West Villages
Summary:

On July 17, 2007, the City and Orange County entered into an Agreement for Delivery and Use of Reclaimed Water for the Horizon West Villages, "Agreement", pursuant to which the County became a customer of the Water Conserv II facilities for the purpose of providing wholesale reclaimed water service to the Horizon West Villages in unincorporated Orange County.  The Agreement authorized delivery to the County of up to 2,333,000,000 gallons per year of reclaimed water.  Due to substantial additional development in the Horizon West Villages, the County has requested an increase in their allocation.  Pursuant to the attached First Amendment, the County limit would be increased to 5,475,000,000 gallons per year provided that any amount in excess of the original allocation, does not interfere with existing customer obligations of Water Conserv II.

Recommended Action:
Approval of the attached First Amendment and authorization for the Mayor or Mayor Pro Tem to execute same, subject to the review and approval of the City Attorney's Office.
