Summary:
In March of 2014 Orlando City Council approved an agreement allowing for a reduction in Transportation Impact Fees for a proposed Hampton Inn & Suites Hotel, designed with qualifying features to reflect the lessened traffic impacts as a Transit Oriented Development (TOD).
The Developer has since requested approval of a second hotel project, to be constructed on the adjacent lot to the west known as Phase II, as identified in the Municipal Planning Board Case ZON2017-00013.
As part of the request for approval of Phase II, the Developer notified the City it would not construct the sidewalk and pedestrian facilities originally included in the development order and required in order to meet one of the fee reduction criteria. This included a shade structure between the two subject properties adjacent to the Columbia Street right-of-way, and a continual pedestrian sidewalk connection through the property to the future Lake-of-the-Woods multi-use trail.
At the time of permit issuance for Phase I, a 20% portion of the fee assessment was held pending final inspection. As the Developer no longer intends to meet the sidewalk and pedestrian facility requirement that allowed them a 20% reduction in transportation impact fees, this money shall not be returned to the Developer and shall be considered satisfaction of the required transportation impact fees for Phase I.
