Summary:
The City, the Greater Orlando Aviation Authority, "GOAA" and Tavistock Development Company, LLC, "Tavistock", entered into a Real Estate Purchase, Land Development and Management Agreement, "Agreement," on March 7, 2017. Under the terms of the Agreement, Tavistock is to purchase from GOAA and the City approximately 782 acres of the Poitras Property, located in southeast Orlando, for residential development and an additional 380 acres that is currently subject to a Conservation Easement. On June 5, 2017, Council approved a First Amendment to the Agreement which extended certain deadlines due to the complexity of the proposed sale. The parties now desire to enter into a Second Amendment to the Agreement to establish (i) the purchase price for the residential property is $60,789,500.00 and (ii) the purchase price of the Conservation Easement property is $3,500.00 per acre for the wetlands portion and $30,000.00 per acre for the uplands portion, for a total of $2,956,000.00. Lastly, if any portion of the upland property is ultimately released from the Conservation Easement in the future, Tavistock will pay an additional $55,000.00 for each such acre released. The Second Amendment was approved by GOAA at its meeting on August 16, 2017. Per the Amended and Restated Operation and Use Agreement between GOAA and the City, all proceeds of the sale inure to GOAA. |
