Encroachment Agreement and Termination of License Agreement - 1521 W. Ivanhoe Blvd.

Pursuant to a License Agreement dated April 10, 2008 the City granted a license to the owner of the property located at 1521 West Ivanhoe Blvd. to allow for a portion of a wood deck located on Licensee’s property to encroach into Lake Ivanhoe. The current property owners, Roy and Constance Brand, are in the process of selling the property, and desire to terminate the License, and the City will enter into a new Encroachment Agreement with the new owner of the property.  The Encroachment Agreement will grant a license to allow the wood deck and boat house to encroach into Lake Ivanhoe and for small portions of a metal fence, deck, pool, brick wall and brick walkway to encroach into the Ivanhoe Blvd Right of Way.   The license is revocable by the City. The owner is required to maintain the encroachments and indemnify the City.

Recommended Action:

Approval of the following agreements in substantially the form attached and authorization for the Mayor and City Clerk to execute same, subject to review by the City Attorney's office: 

A) Termination of License Agreement

B) Encroachment Agreement
