Subordination of Utility Interest between Florida Department of Transportation and the City of Orlando
Summary:

BMRS ORANGE AVENUE, LLC. "BRMS", is developing certain property in the northeast quadrant of Orange Avenue and Michigan Street.  In conjunction with the development, and due to the fact that Orange Avenue is a State Road in this area, the Florida Department of Transportation, "FDOT",  has required that BMRS convey an easement to FDOT over the sidewalk BMRS is constructing.  FDOT is also requiring the City to subordinate its utility interest in the area underlying the easement.  City staff have no objection to the subordination.

Recommended Action:
Approval of the attached Subordination and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
