Summary:
This proposed Land Development Code Amendment implements minor updates to the Chapter 58 Zoning District Regulations and Allowable Use tables, and Part 4H Personal Storage Facilities to allow personal storage facilities as a Conditional Use in the MU-2, AC-1, AC-2, AC-3, IC, IG and IP zoning districts throughout the City. These uses are currently permitted in the AC-1, AC-2, AC-3 outside the Traditional City and in the I-C, I-P and I-G districts in the entire City. These uses are already allowed as a Conditional Use in the MU-1 zoning district.
This amendment opens up more areas of the City for locating personal storage uses, while ensuring compatibility with surrounding uses through the use of conditional use performance standards. The conditional use requirements seek better siting and design requirements to ensure the transition between storage facilities and the residential, mixed-use and commercial areas of the City are carefully considered.
This Land Development Code Amendment was recommended for approval at the April 2017 Municipal Planning Board (MPB); the minutes and recommendations of this MPB meeting were approved by the City Council on May 15, 2017. Since this meeting, staff has modified some of the Conditional Use standards within the draft ordinance to clarify the secondary principal use requirements that are expected to be included in the development program of certain personal storage uses, depending upon the location:

MPB Language: In MU and AC zoning districts at least 1,000 square feet of the ground floor area must be devoted to at least on additional principal use.

New Language: In MU and AC zoning districts at least 10% of the ground floor area, and no less than 75% of the primary street frontage, must be devoted to at least one additional principal use.
As this particular code amendment also amends the table of allowable uses, the Council must separately vote by a majority plus one to hear one of the two required readings prior to 5:00 pm; the staff proposes that the Council take such vote on this first reading/hearing, so that the second reading/hearing may be heard prior to 5:00 pm.

Recommended Action:
Approval of the attached ordinance No. 2017-27 on first reading and authorize the Mayor and City Clerk to present the draft ordinance at the next available City Council meeting for second reading, hearing and adoption.
Additional vote by the Council to hear the second reading/hearing of this ordinance prior to 5:00 pm at the next regularly scheduled City Council meeting. |
