Temporary Use Permit for a Mercedes-Benz South Orlando Temporary Vehicle Storage Lot within the Sabin Planned Development

Summary:

Phillip Whitehill, Director of RLH Construction, requests approval of a 12-month Temporary Use Permit to allow Mercedes-Benz of South Orlando (4301 Millenia Blvd.) to operate a 150-space vehicle storage lot on a 1.37-acre portion of the Sabin (Windrush-Radebaugh) Planned Development (PD). The subject parcel is located on the west side of the southern portion of Millenia Blvd., south of I-4 and north of Millenia Palms Dr.

The applicant noted that “the existing Mercedes-Benz dealership [at 4301 Millenia Blvd.] has outgrown its location and intends to relocate to the Sabin (Windrush-Radebaugh) property. The temporary parking lot will be used for vehicle storage only and is not intended to be used for sales or other customer interaction.

The proposed parking lot will be paved and will be secured with temporary fencing, lighting and full-time security, with security personnel having the only non-inventory parking allowed on the property. The temporary fencing will be 6-foot high black vinyl-coated chain link fence (no barbed wire) and the temporary lighting will consist of 30-ft. tall shielded fixtures to minimize light trespass onto adjacent multi-family residential properties.

Once completed, the temporary lot will be used for vehicle inventory storage for a period of up to 12 months. Within 4 months of completing the temporary parking lot, an application for Master Plan approval will be submitted to the City of Orlando for the new Mercedes-Benz of South Orlando relocation. Final design and permitting will then take place, with the goal being to commence construction on the relocated facilities as quickly as possible. Upon commencement of construction for the relocated facilities, the temporary vehicle inventory lot will cease but may be used as a secure staging area during construction of the relocated dealership. At the appropriate time during construction of the relocated facilities, the temporary parking lot and associated fencing and lighting will be removed and replaced with permanent improvements consistent with the approved Master Plan.

City Code Section 58.831 limits a temporary use to a maximum period of six (6) months within a 12-month period, unless otherwise authorized by City Council. On May 17, 2017, Planning staff approved a Letter of Determination for a Temporary Use Permit for the requested Mercedes-Benz Inventory Storage Yard (LDC2017-00204), for a period not to exceed 6 months (to November 17, 2017), with the conditions noted below under recommended action.

Recommended Action:

Approve the request for the 12-month Temporary Use Permit to allow Mercedes-Benz of South Orlando to operate a 150-space vehicle storage lot on a 1.37-acre portion of the Sabin (Windrush-Radebaugh) Planned Development (PD), with the following conditions:

 

1.  Consistency - The proposed improvements shall be consistent with the size, dimensions and location shown on the plan submitted with the application and as described above.

2.  The temporary vehicle storage lot shall be surrounded/bordered by a 6-foot high black vinyl-coated chain link fence (no barbed wire).

3.  Temporary security lighting will consist of 30-ft. tall shielded fixtures to minimize light trespass onto adjacent multi-family residential properties, consistent with Chapter 63, Part 2M, City Code.

4.  Security personnel will have the only non-inventory parking on the property.

5.   Unloading of vehicles into the vehicle storage yard must NOT occur on Millenia Blvd. Vehicle transport vehicles must use Millenia Palms Dr. or the entry drive into said vehicle storage yard from Millenia Palms Dr. Damage to City rights-of-way caused by transport of vehicles, or equipment when used for a secure staging area, must be repaired, as required by City code and acknowledged by you in a letter included with the site permit application.

6.   Vehicles or equipment stored within the subject storage yard shall not exceed 10 ft. in height.

7.   Upon completion of construction of the new South Orlando Mercedes Benz dealership, the subject property, if not made part of the new dealership, must be restored to the condition it was prior to the creation of the vehicle storage lot.
