Summary:
The Greater Orlando Aviation Authority, "GOAA" and All Aboard Florida-Operations, LLC, "AAF", entered into the Premises Lease and Use Agreement, "Agreement", on January 22, 2014. The Agreement provided for AAF''s construction of facilities, and use of property, at the Orlando International Airport, "OIA," for rail station purposes. (GOAA controls the OIA property, which is owned in fee simple by the City, under the terms of the Amended and Restated Operation and Use Agreement.) GOAA and AAF desire to amend the Agreement to address changes to the primary infrastructure allowance costs, arising from the delay in the initiation of construction. The City is not a party to the Amendment but will execute a Joinder to evidence its consent as the fee simple owner. |
