Partial Release of Water Line and Access Easement Agreement
Summary:

On January 14, 2004, Lake Nona Land Company, "Lake Nona", BAS, LLC, "BAS", the Orlando Utilities Commission, "OUC", and the City, entered into a Water Line and Access Easement Agreement, "Agreement".  Under the terms of the Agreement, OUC was authorized to install certain potable water facilities, "Facilities," within the Easement Area.  In 2006, the Agreement was amended to reflect a relocation of a portion of the Facilities.  Lake Nona has now requested a Partial Release of the Agreement to the extent it encumbers property referenced as Parcel 15, a 67 acre tract located along the north boundary of State Road 417.  OUC has reviewed this request and approved the Partial Release at it's December 2016 Board meeting.

Recommended Action:
Approval of the attached Partial Release and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
