Summary:
The City is the fee simple owner of property, "Poitras Property," which the Greater Orlando Aviation Authority, "GOAA", purchased in 1989 for borrow material in anticipation of the construction of the 3rd and 4th runways and for wetlands mitigation in conjunction therewith. Under the terms of the Amended and Restated Operation and Use Agreement, "Operation and Use Agreement," between the City and GOAA, GOAA controls the Poitras Property which consists of approximately 1800 acres located on the north side of Boggy Creek Road in southeast Orlando. Under the terms of the attached Agreement, GOAA proposes to sell an easterly portion of of the Poitras property (approximately 600 acres) to Tavistock Development Company, "Tavistock,"' for residential development, along with another 379 acres encumbered by a conservation easement, and provide an option for Tavistock to purchase a westerly portion of the Poitras Property (approximately 600 acres) for commercial development, "Commercial Property." In the event that Tavistock does not exercise the option to purchase the Commercial Property, the Agreement provides that Tavistock will act as GOAA's land manager for development of the Commercial Property over the next fifty years. The City's consent to the attached Agreement is required under the terms of the Operation and Use Agreement. However, the benefits, liabilities and obligations will inure to GOAA and Tavistock. Furthermore, the City does not, by virtue of this Agreement, waive it's regulatory authority over the Poitras Property. |
