On July 19, 2016, the Municipal Planning Board (MPB) voted to recommend denial of Applicant’s request seeking various amendments to the Shah Planned Development.

Petitioner timely filed a Request for Hearing Before a Hearing Officer on July 25, 2016. A quasi-judicial hearing was held on October 19, 2016 regarding this matter, at which the parties made arguments and presented evidence and material into the record. Subsequent to this hearing, the Hearing Officer issued the attached Recommended Order, which recommends that the City Council deny the Applicant/Petitioner's request to overturn the MPB's recommended denial of the application.The Applicant/Petitioner timely filed the attached exception's to the Recommended Order.
Fiscal & Efficiency Data: No fiscal impact.
Recommended Action:
Adopt the Recommended Order, accept the meeting minutes, and approve the recommended denial of Item #12, Regular Agenda, of the July 19, 2016 MPB (attached hereto) for the Shah PD application.
