Summary:
The City previously entered into an Agreement with Shingle Creek Real Estate Advisory Company, LLC, (SCA) to assist the City with the design, development and construction of improvements to Camping World Stadium (f/k/a The Citrus Bowl), approved by City Council on September 10, 2012. The Agreement was subsequently amended four times to increase the scope related to the Soccer Stadium project; to extend the term (currently through April 30, 2017); and update fees for provision of continued services during CWS project close-out. The City desires to further amend the scope of services and compensation provisions of the Agreement to include advisory services with respect to potential further improvements (Phase 2) to Camping World Stadium and construction of the Dr. Phillips Center for the Performing Arts Stage 2 (proposed Amendment Five attached).
Amongst other tasks, advisory services will include: continuing to serve as City’s Project Director and Advisor on CWS improvement projects (as may be funded); and serving as City’s Project Director, City’s Construction Representative and Advisor for the DPC Stage 2 project. Both projects will be very complex and will require a significant effort to ensure the proper coordination of work with project partners (DPC, Florida Citrus Sports), City staff, and for the CWS project, with various consultants, contractors and venue operations. In addition, as a component of the Community Venues plan, significant effort will be required to make sure all components of that plan are accomplished and proper accountability is achieved, including compliance with Blueprint, and Venues Interlocal Agreement.
SCA has extensive experience in real estate and project development. Most relevant is the fact that SCA has served as an advisor to the Orlando Magic on the Amway Center project, to the City on the Citrus Bowl Reconstruction project and is therefore uniquely qualified to advise the City on further CWS improvements and the DPC Stage 2 projects. Specifically,
* SCA has a considerable understanding of City project management and Venues operations requirements having worked with City departments and staff involved in implementation of the Community Venues plan;
* Through the Amway Center and Citrus Bowl Reconstruction projects SCA has developed unique knowledge and experience managing a project budget, reviewing and approving requests for payment, and satisfying audit requirements for complicated projects guided by the Venues Interlocal Agreement and its multiple funding partners;
* SCA has experience implementing the Blueprint and will use that experience to ensure the projects conform to the objectives of that program;
* SCA has knowledge of the City’s Procurement Code and experience implementing and administering an owner direct purchase program; and
* There will be key dates to be met to facilitate the ongoing programmatic objectives of the facilities, as well as a need to maintain the project timelines in order to market the facilities.
Given those time constraints, City Council approval is requested to enter into a negotiated procurement for advisory services with Shingle Creek Real Estate Advisory Company, LLC. The amended contract period will be for 48 months (through December 2020), with option to extend as necessary to ensure completion of the projects, at a base monthly rate of $8,500 ($12,500 when services are provided concurrently for both DPC Stage 2 and Camping World Stadium Phase 2 projects). Approval is also requested to negotiate and contract with SCA for additional professional services, if necessary, at a multiplier agreed upon by the parties. |
