Parking Agreement between City and Orange County School Board for use of Parking Spaces in Centroplex Parking Lot 4 and VoTec Garage

Summary:

The City and Orange County School Board (OCSB) previously entered into an Agreement dated October 10, 2007, providing for the shared use of OCSB’s and City’s parking facilities in the area near the City’s Centroplex Parking Complex (now know as Creative Village).

This Amended and Restated City/School Board Parking Agreement (Agreement) is for OCSB’s continued use of parking spaces in the City’s Centroplex Parking Complex Lot 4 (City Parking Area) and the City’s continued use of OCSB’s VoTec Garage (OCSB Parking Area) located in OCSB’s Educational Leadership Center.  Both City’s and OCSB’s use of the respective parking areas shall be free of charge.  

The term of the Agreement shall be for five (5) years, expiring in December 2021, and the term may be renewed annually thereafter.  Either party may terminate the agreement with ninety (90) days notice.  The City Parking Area is subservient to a Master Development Agreement between City and Creative Village Development, LLC.  The City may terminate OCSB’s use of the City Parking Area when development of the Creative Village has progressed to the point that it is necessary to terminate access to the City Parking Area however, City shall be allowed to continue to use OCSB Parking Area so long as it is available.

Recommended Action:

Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Agreement, substantially in the form attached, and authorization, without further City Council approval, for the Real Estate Division Manager to execute the renewal options, so long as such approvals are in conformance with the terms and conditions of the Lease, all subject to the review and approval of the City Attorney’s Office.
