Ordinance No. 2016-77 granting Natural Gas Franchise Agreement for Peoples Gas System

Summary:

The City of Orlando granted a non-exclusive Natural Gas Franchise to Peoples Gas System, a division of Tampa Electric Company, in 2006 for a ten year term (until 2016). Peoples Gas System/TECO and City staff have negotiated a new franchise agreement with the same terms as the previous Franchise Agreement, including the 6% Franchise Fee. The term of the non-exclusive franchise is ten (10) years through 2026, with an option to an additional ten (10) year renewal term upon agreement by Peoples Gas System/TECO and the City. Construction standards and specifications for the system in the City's rights-of-way are subject to the City’s approval and insurance and indemnification requirements are imposed. A non-assignability clause prevents the system from being transferred to another entity without the advance written approval of the City.


Fiscal & Efficiency Data:

The City will continue to receive franchise fee revenue for the use of the City’s rights-of-way.


Recommended Action:
Adoption of the attached Ordinance No. 2016-77 as drafted and authorization for the Mayor/Mayor Pro Tem and City Clerk to execute the same upon adoption, subject to review and approval by the City Attorney’s Office.
