| | | | | | | | | Subject: | Right-of-Way Encroachment Agreement between City of Orlando and Crestview Condominiums of Orlando Condominium Association, Inc. | | Summary: | The Crestview Condominiums of Orlando, "Crestview," are located at 7101, 7109, 7123 and 7151 Yacht Basin Avenue. The residents of Crestview currently utilize a dumpster located in a cul-de-sac at the terminus of Yacht Basin Avenue, a City street. Due to non-residents leaving large items of refuse in and around the dumpster, Crestview has requested permission to construct a fence across Yacht Basin Avenue which will limit access to the dumpster to residents of Crestview and Orange County Solid Waste. Crestview is responsible for construction/maintenance of the fence as well as maintenance of the right-of-way enclosed by the fence. The Agreement requires Crestview to insure and indemnify the City and is terminable at will, upon which termination, Crestview will remove any and all improvements at its cost. | | Fiscal and Efficiency Data: | N/A | | Recommended Action: | Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office. | | Contact: | Roy K.
