Summary:
Ordinance No. 2016-60 would amend Chapter 62, Orlando City Code, to allow certain variances from typical building setback standards to be approved by certificate of appropriateness in the City's historic preservation zoning overlay districts. Under existing code, setback variances for buildings in historic preservation districts must be reviewed by both the Historic Preservation Board (using the HPB's typical standards of review for work inside historic preservation districts) and the Board of Zoning Adjustment (using the BZA's typical hardship standards of review). This dual review results in added expense and time for applicants and City staff, and can result in conflicting recommendations from the two boards. The proposed amendment would authorize certain lesser or greater setbacks if the lesser or greater setback is consistent with the prevailing pattern of historically contributing development in the vicinity of the proposed building. This standard of review would be applied by staff, the HPB, and Council as part of the application for certificate of appropriateness and would not require additional review by the BZA. |
