Univ Club R-O-W Encroachment and Maintenance Agmt
Summary:

UC Orlando Central, LLC (“UC”) has requested permission to install a planter within the right-of-way ("R-O-W") on Pine Street. The attached Encroachment and Maintenance Agreement authorizes the UC to install and maintain the planter at its cost and obligates UC to insure and indemnify the City against liability arising therefrom. The planter will be used solely for the purpose of treating stormwater runoff generated within the R-O-W.

Under the terms of this Agreement, City shall not be responsible for maintaining or repairing any portion of the Improvements, now or at any time in the future. In the event of damage to City property, or any other property arising from UC's activities, or the activities of anyone for whom UC is responsible, under this Agreement, the UC, at its sole cost and expense, must immediately undertake and complete repairs to said property.

There is no cost to the City of Orlando associated with this agreement

 

 
Recommended Action:
Approval of the Agreement in substantially the form attached and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office
