Subject:the Fourth Amendment to the Amended and Restated Interlocal Agreement between the City of Orlando and the Central Florida Regional Transportation Authority, d/b/a LYNX relating to the Downtown Orlando East/West Circulator New Starts Project
Summary:

On February 24, 2015, the Central Florida Regional Transportation Authority, d/b/a/ LYNX (the “Authority”), entered into a Design-Build Contract 14-C26 with Balfour Beatty Construction, LLC (“BBC” or “Design-Builder”) for the construction of a Parramore bus rapid transit (BRT) project and a Parramore Environmental remediation project, both of which were funded in part through the Interlocal Agreement.

During the course of excavating test pits along Terry Avenue, BBC uncovered subsurface debris which BBC later identified and removed.  The costs related to the subsurface debris are not contained in the FTA Grant; therefore the City has agreed to pay the debris costs to the extent described in the Fourth Amendment. The debris costs are in addition to and not a part of the Parramore BRT Local Match.

The City has agreed to pay the Authority an amount not to exceed $500,000.00, to be used by the Authority to pay the Design-Builder for the identification and removal of subsurface debris as well as any associated project delay costs resulting therefrom.

Recommended Action:Approval of the amendment to the Interlocal Agreement between the City of Orlando and LYNX, and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the Office of Legal Affairs.
