Ordinance No. 2016-51 Abandonment of Ohio St. and Portions of Michigan Ave. & Harmon Ave. (ABN2015-00001)(Economic Development)

Summary:

The attached ordinance will abandon three (3) streets or street segments within or adjacent to the Calvary Assembly of God campus off Clay St. and Minnesota Ave. The proposed abandonments include:

 A.    Ohio St. (between Minnesota and Michigan Avenues)

  B.   A portion of Michigan Ave. (between Ohio St. and Clay St.) and

 C.    That part of Harmon Ave. (between the Calvary Assembly of God property and a separately owned lot, west of Clay St.).

 

These rights-of-way (R-O-Ws) are abutted/surrounded by Calvary Assembly of God. The applicant is Debby Carey, Administrator, with Calvary Assembly of God.

The purpose of the abandonment request is to create a more cohesive site for potential long-term redevelopment of portions of the site.

There are no known utilities in the Ohio St., Michigan Ave. and Harmon Ave. right-of-way segments but if utilities are found, the applicant will bear the responsibility to either have them removed and relocated or retained in place via easements with respective utility provider(s).

 

The abandonment request was unanimously approved on consent agenda at the June 16, 2015 Municipal Planning Board, with the City Council subsequently approving the June 2015 MPB minutes on July 27, 2015. The applicant then had to provide a more thorough survey for the street segments before the verified legal could be reviewed and the item scheduled for City Council for review and approval of the abandonment request (hence the delay since the June 2015 MPB meeting).

Recommended Action:

Approve the attached Ordinance No. 2016-51 on first reading and request that the Mayor and City Clerk present the draft ordinance for second reading and public hearing at the next regular City Council meeting.
