First Amendment to Lease of 6731 S. Kirkman Road for OPD Kirkman/I-Drive Substation with DDM Management Inc.


On June 21, 2010, Council approved the lease of a 3,500 square foot office space at the intersection of I-Drive and S. Kirkman Road in the International Festival Center for an OPD substation.  OPD favors this location as compared to its previous location on Grand National Drive as it is more strategically located, provides greater visibility and faster Police response time to businesses in the I-Drive corridor. 

Currently, OPD pays Rent of $1.00 per year and a monthly Common Area Maintenance (CAM) charge of $1,000 per month.  The initial Lease term was for five (5) years with four (4) additional extension terms of one (1) year each, under the same terms and conditions as the Lease.  The Lease has been extended once on the same terms, now the Landlord has proposed to increase the CAM charge from $1,000 per month to $1,400 per month for the three 3 remaining extension terms. 

Pursuant to the attached First Amendment to Lease (Amendment), the term is extended for a period of one year, commencing on July 1, 2016 and ending on June 30, 2017, the CAM charge will increase as of August 1, 2016, and all other terms and conditions of the Lease will remain unchanged.

Recommended Action:

Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Amendment, substantially in the form attached, and approval and authorization, without further City Council approval, for the Real Estate Division Manager to execute the additional extension options referenced herein, so long as such extensions are in conformance with the terms and conditions of the Lease, all subject to the review and approval of the City Attorney's Office.
