Subject:Street Right-of-Way Utilization and Encroachment Agreement between City of Orlando and Wedgewood Groves Homeowner's Association, Inc.
Summary:

The Wedgewood Groves Homeowner's Association, Inc., "Association", has requested permission to install a fence (to prevent pedestrian access) along the right-of-way line for Watauga Avenue at the intersections of Watauga Avenue and Brandy Street and Watauga Avenue and Grant Street, all of which are City streets.  Under the terms of a 1994 agreement between the City and the Association, both of the intersections are currently closed to vehicular traffic but do provide pedestrian access to the Wedgewood Groves neighborhood which is located east of Conway Gardens Road and west of Watauga Avenue.  The attached Agreement authorizes the Association to install and maintain the fence, at its cost, and obligates the Association to insure and indemnify the City against any liability arising therefrom.  The Agreement also authorizes the City to terminate the Agreement upon thirty days notice and require removal of the fence at the Association's cost.

Recommended Action:Approval of the Agreement in substantially the form attached and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
