The terms of the original Economic Development Transportation Project Fund Agreement (Off-System) for the “Construction of infrastructure improvements within the right-of-way or on land owned by the City”, executed on April 30, 2014, are hereby amended as follows: Remove and add revised Section 3.0 Commencement and Completion.

3.0 Commencement and Completion: Unless terminated earlier under Section 10.0 or modified under Section 24.0, work on the Project shall commence no later than: the 1st day of June, 2016, or the date of issuance of the Notice to Proceed, whichever date is earlier (“Commencement Date”), and shall be completed on or before December 31, 2016. FDOT shall have the immediate option to terminate this Agreement should the Agency fail to meet either of the above-required dates.

Except as hereby modified, amended or changed, all of the terms and conditions of said original Agreement thereto will remain in full force and effect.

Approval of the Economic Development Transportation Project Fund (“EDTPF”) Agreement Amendment Number 3 and authorization for the Mayor or Mayor Pro-Tem to execute same, subject to review and approval by the City Attorney’s Office.
