Ordinance 2016-11 Annexing property located north of Tavistock Lakes Boulevard, east of Lower Harden Avenue, south of Lake Nona High School, and west of Narcoossee Road (Blackfin Shoppes) (Economic Development)

Summary:

The attached ordinance is to annex property that is ±14.63 acres in size and is located north of Tavistock Lakes Boulevard, east of Lower Harden Avenue, south of Lake Nona High School, and west of Narcoossee Road.

City Council accepted a petition for the voluntary annexation of this property on September 21, 2015. On October 20, 2015, the Municipal Planning Board recommended approval of the annexation (ANX2015-00017), the GMP amendment to assign the Urban Village future land use designation (GMP2015-00033), GMP amendment to add the subject to the Southeast Orlando Sector Plan (GMP2015-00034) and initial zoning of PD for 37,000 square feet of mixed use development (ZON2015-00030). 

The property is currently vacant with the exception of an existing cell tower.  The applicant is proposing to develop a mixed use development on the site.  The cell tower will remain on the site.

The subject property is contiguous to the City limits. If annexed, the property will not create an enclave. The proposed annexation meets all requirements under Chapter 171, Florida Statutes. Unless appealed, all three actions will be effective 31 days after adoption. 

The first reading of this ordinance was on the January 25, 2016 Council Agenda.

Recommended Action:
Adopt the attached ordinance number 2016-11 and authorize the Mayor and City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
