Summary:
Orlando Soccer Stadium, LLC, “OSS”, is constructing a stadium, “Stadium,” on property located east of Glenn Lane, south of Central Blvd., west of Terry Avenue, and north of Church Street. Per an agreement between City and OSS, the City is responsible for ensuring the relocation of underground utilities to accommodate Stadium construction. Bell South Telecommunications, LLC, “AT&T” owns certain telecommunication lines, “Lines,” that must be relocated and the City and AT&T are in disagreement as to which entity is responsible for the cost. In order to expedite relocation of the Lines and the Stadium construction, the City would (i) pay AT&T the cost of relocating the Lines in the amount of $3,374,856, (ii) convey an easement to AT&T for installation of the Lines and (iii) reserve the right to seek reimbursement of all funds paid to AT&T upon completion of the relocation. |
