First Amendment to Winter Garden Agreement for the Delivery and Use of Reclaimed Water between City, Orange County and the City of Winter Garden
Summary:

In January 2009, the City, Orange County and the City of Winter Garden entered into the Winter Garden Agreement for the Delivery and Use of Reclaimed Water, "Agreement," by which the City/County provided reclaimed water to the City of Winter Garden.  In conjunction with the City of Winter Garden's purchase of certain reclaimed water facilities from the City/County pursuant to a Purchase Agreement being approved on the same date hereof, the Agreement must be amended to reflect changes in the provision of reclaimed water to the City of Winter Garden.

Recommended Action:
Approval of the attached First Amendment and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
