Right-of-Way and Easements Agreement between the City of Orlando and All Aboard Florida-Operations, LLC

Summary:

The City owns a stormwater pond, "Pond," located in the southeast quadrant of the Narcoossee Road/State Road 528 interchange.  All Aboard Florida-Operations, LLC, "AAF," intends to construct and operate a passenger rail system, "Project," along the State Road 528 corridor in that area.  In conjunction with construction and operation of the Project, AAF must acquire a small portion of the Pond site from the City as right-of-way along with certain access easements and a temporary construction easement.  In addition, AAF must obtain authorization from the City to cross the adjacent section of Narcoossee Road.  City staff have reviewed the plans for construction of the Project and determined that acquisition of the right of way/easements and construction/operation of the Project will not negatively impact the functional capacity of the pond or the City's operation/maintenance of the adjacent section of Narcoossee Road.

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to the review and approval by the City Attorney's Office.
