Lake Hart Storage, LLC, "Lake Hart" owns property, "Property," located at 11301 Narcoossee Road in unincorporated Orange County.  By virtue of an Easement Agreement, dated January 28, 1998, the City owns and maintains a stormwater pond, "Pond," adjacent to the Property. In conjunction with development of the Property, Lake Hart has notified the City that it intends to relocate and alter the Pond.  The provisions of the Easement Agreement authorize Lake Hart to do so as long as (i) the work is at Lake Hart's sole cost, (ii) all necessary permits are obtained, (iii) replacement easements are created and (iv) the work does not impact the functional capacity of the Pond.  All of the above criteria have been met and are memorialized in the attached Agreement.
