Plat Agreement between City of Orlando, FB Orlando Acquisition Company, LLC and Store Master Funding VIII

Summary:

FB Orlando Acquisition Company, LLC, "FB Orlando," owns a portion of the commercial development known as Festival Bay, "Property." In conjunction with the renovation and redevelopment of the Property, FB Orlando prepared and recorded a plat, entitled Festival Bay Replat, at Plat Book 80, Page 58, Public Records of Orange County, Florida, "Plat".  The Plat contains General Note Number 4 which provides that maintenance of Tract C, a drainage easement, is the responsibility of the Lot 1 owner. City of Orlando, FB Orlando and Store Master Funding VIII, "Store Master," by means the attached agreement, propose to amend General Note 4 so that maintenance of Tract C is the responsibility of the owner of Tract C or as provided in the Operation and Easement Agreement that encumbers the Property.  (Store Master is included as a party because it currently owns one of the lots in the Plat.)

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
