Addendum to GRIP Contract at Former Spellman Engineering Site

Summary:
The City and Arcadis, U.S., Inc. entered into a Guaranteed Remediation Program Agreement (“Agreement”) dated October 20, 2008 for the Former Spellman Engineering Site ("Site") for the express purpose of, among other things, achieving a 90-Percent Reduction in dissolved-phase Contamination in groundwater from Demonstration Wells at the Site for two consecutive quarters of groundwater sampling (“Project Completion”). The City believes that there may be additional masses of chlorinated solvents beneath an adjacent building associated with the portion of the plume that was remediated by thermal treatment by Arcadis which, in the City’s opinion, should be further evaluated by additional sampling and testing. In an effort to work together in a spirit of cooperation, Arcadis has agreed to reduce their final payment, and thus the Agreement amount, by $85,000 to let the City further assess the area east of the thermal treatment area to investigate contaminant levels.

Fiscal & Efficiency Data: No net fiscal impact (refund of Agreement amount of $85,000, which will then be spent by the City on additional assessment work).

Recommended Action:
Approval and Authorization for the Mayor/Mayor Pro Tem to execute the Addendum to Guaranteed Remediation Program Agreement
