Street Right of Way and Trail Encroachment and Removal Agreement between City and CRP II-Mills Park, LLC and Mills Park Apartments, LLC
Summary:

CRP II-Mills Park, LLC and Mills Park Apartments, LLC, "Owner", own property located in the northwest quadrant of Mills Avenue and Virginia Avenue, known as the Mills Park Development, "Development".  In conjunction with construction and operation of the Development, Owners have constructed a driveway and certain utility, landscape and sidewalk improvements, "Project," over and across a portion of Haven Drive and the Dinky Line Bike Trail, both of which are owned and operated by the City. The attached Agreement authorizes Owner's construction, maintenance and repair of the Project and also provides that the Owner will insure and indemnify the City against any liability arising from use of the Project improvements within City right of way.

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
