Sanitary Sewer Easement Agreement between City and Baldwin Cove Homeowners Association, Inc.
Summary:

In conjunction with the construction of a single family development, known as Baldwin Cove, between Beach Boulevard and Old Cheney Highway, the Developer installed a private sewer line, "Line," within the right-of-way for Baldwin Cove Way, a City street. As a condition of development, the Baldwin Cove Homeowners' Association, which has assumed responsibility for the Line, must obtain an easement from the City. Per the terms of the attached Easement Agreement, the Association is responsible for maintenance, repair and operation of the Line and will insure and indemnify the City against any such liability.

Recommended Action:
Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
