Amended and Restated Lease between City of Orlando and SUPERRICO Columbia, LLC (fka Que Rico, LLC) for premises located within the Central Parking Garage.

Summary:

 

 

SUPERRICO Columbia, LLC (Tenant) has leased 57 W Central Blvd in the Central Parking Garage (Garage) for its restaurant business per the Lease Agreement between City of Orlando and Que Rico, LLC, dated October 22, 2012 (Lease).  The Lease was amended per Amendment One dated May 6, 2013, for the purpose of adding space for the placement of a propane storage tank.  The Lease was amended again per Amendment Two dated October 22, 2014, for the purpose of moving the propane storage to a new location. 

The Tenant has requested to lease an additional space located on the north side of the Central Parking Garage so that its leased premises include 57 W Central Blvd and 62 W Washington St.  The Tenant shall operate its restaurant business in both locations pursuant to terms and conditions set forth in the attached Amended and Restated Lease.

The term of the Lease shall be three (3) years commencing July 1, 2015 and ending June 30, 2018.  Upon mutual agreement of the parties, the Lease may be extended for two (2) additional terms of one (1) year(s) each and either party may terminate the lease at its convenience upon ninety (90) days notice.  Beginning July 1, 2015, rent shall be $2,293.23 per month ($17.80 psf) and shall increase at a rate of five percent (5 %) annually.

Recommended Action:
Approval and authorization for the Mayor/Pro Tem and City Clerk to execute the Amended and Restated Lease, substantially in the form attached, and authorization, without further City Council approval, for the Real Estate Division Manager to execute the renewal options so long as such approvals are in conformance with the terms and conditions of the Amended and Restated Lease, all subject to the review and approval of the City Attorney’s Office.
