Subject:City of Orlando/Universal Cross Access and Maintenance Agreement
Summary:
On June 12, 2013, the City, the City of Orlando Community Redevelopment Agency and Universal Orlando entered into the I-4/Republic Drive Community Redevelopment Area 2013 Cooperation Agreement.  Pursuant to the Cooperation Agreement, Universal designed and constructed a pedestrian bridge from the new Cabana Bay Beach Resort, over Adventure Way, including additional sidewalks, to provide access to various portions of Universal Orlando Resort. Pursuant to Section 4.17 of the Cooperation Agreement, Universal is to convey the pedestrian bridge and attendant sidewalks to the City and the City and Universal are to establish obligations related to Bridge maintenance and use, including cross access easements. Under the terms of the attached Agreement, Universal remains responsible for day-to-day operation and maintenance of the improvements and will insure and indemnify the City against liability arising from use of the Bridge.  The City will provide capital repairs.
Fiscal and Efficiency Data:Depending on cost and fund balance, capital repairs to the bridge and sidewalks will be funded from:
  • STW0007_P Pavement Rehabilitation, Gas Tax
  • STW0009_P Pavement Rehabilitation, Capital Improvement Plan
  • STW0012_P Miscellaneous Sidewalk, Gas Tax

Recommended Action:Approval of the attached Agreement and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
