Landscape Construction and Maintenance Memorandum of Agreement between Florida Department of Transportation and City of Orlando

Summary:

Pizzuti Sevens, LLC is developing The Sevens Apartments on property located at 777 N. Orange Avenue, “Project”.  In conjunction with development of the Project, Pizzuti is proposing to construct and maintain certain landscaping and streetscaping, including sidewalks, "Improvements", within a portion of Orange Avenue right-of-way owned by the Florida Department of Transportation, “FDOT.”  As a condition of locating the Improvements within FDOT right of way, FDOT is requiring that the City assume responsibility for construction and maintenance of the Improvements as provided in the attached Agreement. However the City is transferring all of said obligations to Pizzuti Sevens, LLC pursuant to a separate Agreement between the City and Pizzuti which is also before City Council.

Recommended Action:
Approval of the Agreement in substantially the form attached and authorization for the Mayor or Mayor Pro Tem to execute same, subject to review and approval by the City Attorney's Office.
