Ordinance No. 2015-08 Amending The Land Development Regulations For The Nona Park Planned Development District, Located Generally At the Southwest Corner Of The Intersection Of Narcoossee Rd. And Dowden Rd. And Comprised Of 26.1 Acres Of Land, More Or Less; Providing An Amended Development Plan For Certain Lots Of The Planned Development District; Providing Amended Special Land Development District; Providing Amended Special Land Development Regulations And Permitted Uses In The Planned Development District (Nona Park, ZON2014-00027) (Economic Development)

Summary:

This PD is located at the southwest intersection of Dowden Rd and Narcoossee Rd.  The existing PD was adopted in 2007 and last amended in 2013.  That last amendment allowed 302 multi-family dwelling units, 63,000 sq. ft. of retail, 48,000 sq. ft. of mixed office/retail and 19,000 sq. ft. of eating and drinking.  The proposed PD amendment will change the development plan for lots 2-7, specifically allowing FAR to be calculated based on the overall development of lots 2 -7, and allow for the option of personal storage use on lot 7.  The PD is and will continue to be subject to the standards of the ASD-1 zoning district.

Previous actions regarding this application are as follows:

·         October 2007- City Council approved the existing PD ordinance (Doc. #0110151004)

·         July 2012-  MPB recommended approval of the Growth Management Plan (GMP2012-00010) amendment to change the future land use designation for the subject property from Airport Support District – High Intensity to Airport Support District – Medium Intensity to allow for a multi-family residential development on portions of the Property and the zoning application (ZON2012-00010) recommending that the development standards, site plans, and conditions associated with the previously adopted PD Ordinance for the Property be amended to allow for the construction of 302 multifamily dwelling units where an approximate 200,000 square-foot big box retail facility had previously been approved.  This item was subsequently appealed.

·         October 2012- A quasi-judicial hearing (QJ2012-004) was held in which the Petitioner’s grievances were heard in front of a Hearing Officer, who subsequently decided to uphold the findings of the MPB in their entirety.

·         December 2012- City Council approved the Hearing Officer’s Recommended Order and Accepted the MPB Minutes of July 17, 2012

·         March 2013- City Council adopted the GMP amendment to change the future land use designation for the subject property from Airport Support District – High Intensity to Airport Support District – Medium Intensity (GMP2012-00010)

·         April 2013- City Council adopted an amended and restated Nona Park PD allowing 302 unit multi-family development in addition to previously approved office and commercial uses.

·         April 6, 2015- City Council approved the first reading of the subject PD amendment ordinance.

Recommended Action:

Adopt the attached ordinance number 2015-08 and authorize the Mayor and the City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
