Ordinance 2015-14 of the City Council of the City of Orlando, Florida, Amending the Orlando Health Planned Development Zoning Ordinance to Add Approximately 0.53 Acres of land to the Planned Development Zoning District, Such Land Being Generally Located North of W. Underwood St., East of S. Lucerne Terrace, South of Columbia St., and West of S. Kuhl Ave.; Providing a Conforming Legal Description, PD Planning Area Map, and PD Land Use Plan


Orlando Health requests to incorporate recently-acquired property into its Planned Development ordinance. The 0.53-acre subject property - 60 Columbia St. - is developed with a 1-story, 7,809 sq. ft. medical office building.

The current PD ordinance (adopted March 31, 2014) governs the acquisition and disposition of property by Orlando Health, as follows:

6a. Upon acquisition or disposition of such other properties within the Planning Area Boundary by Orlando Health, the City Council may amend the legal description of the PO Property to add or remove such property without Municipal Planning Board (MPB) review, except as otherwise provided herein.

b. Future land acquisitions by Orlando Health or wholly owned subsidiaries shall be added to the PD by amendment of this PD Ordinance without Municipal Planning Board review.

c. Each request to add properties within the Planning Area to the PD Property shall be accompanied by a legal opinion from an attorney licensed to practice law in the State of Florida stating that the parcel and its development potential, If added to the PD Property, in conjunction with development previously approved on the PD Property does not constitute a Substantial Deviation to the approved DRI Development Order unless approved through the appropriate process.

Orlando Health has submitted a legal opinion, in compliance with (c) above.

City Council approved this ordinance on first reading on April 6, 2015.

Recommended Action:
Adopt the attached ordinance number 2015-14 and authorize the Mayor and City Clerk or Mayor Pro Tempore and City Clerk to execute on behalf of the City upon final review and approval by the City Attorney.
