Third Amendment to the Amended and Restated Interlocal Agreement by and between the City of Orlando, Central Florida Regional Transportation Authority (d.b.a LYNX) and Community Redevelopment Agency (CRA) relating to the Downtown Orlando Transit Circulator Expansion Alternatives Analysis (AA) Study; the Creative Village Moving Parramore Forward Project (Parramore BRT Project); and the Downtown Orlando East/West Bus Rapid Transit New Starts Project (New Starts Project)

Summary:

On June 8, 2009, the Orlando City Council approved the Interlocal Agreement by and between the City of Orlando,  LYNX and CRA related to the Downtown Orlando Transit Circulator Expansion Alternatives Analysis (AA) Study and subsequent funding for the AA study, including the Project Administrative Fee.   On August 15, 2011, City Council approved the Amended and Restated Interlocal Agreement to include the  Parramore BRT Project, the  East-West BRT Project and the Gertrude's Walk Project.  

On October 1, 2012, City Council approved the First Amendment to the Amended and Restated Interlocal Agreement to include the additional $3 million (TIGER II) and a local match of $750,000 for the Parramore BRT Project, including the reconstruction of Terry Avenue and/or Amelia Street, and the purchase of three (3) hybrid electric buses.

On September 8, 2014, City Council approved the Second Amendment to the Amended and Restated Interlocal Agreement to include the funding for environmental remediation with respect to the land on which the Parramore BRT Project is to be constructed.

The proposed Third Amendment includes the following items:

·  Reallocation of certain unused funds, previously earmarked for costs related to the AA Study and the New Starts Project, to the Parramore BRT Project, including LYNX administrative expenses.

·  Amendment to the Parramore BRT local match to reflect an additional contribution to cover wastewater expenses in the amount of $258,000 as part of the cash match of the local match.

·  Allocation of the Terry Avenue and West Livingston Street rights-of-way for the Parramore BRT Project, to be utilized for dedicated BRT lanes and transit access. The appraised value of this property is $2,842,000, which will be treated as an in-kind over match for the Parramore BRT Project. 

This amendment proposes no fiscal impact to the Community Redevelopment Agency.

Recommended Action:
Approving the Third Amendment to the Amended and Restated Interlocal Agreement by and between the City of Orlando, Central Florida Regional Transportation Authority (d.b.a LYNX) and Community Redevelopment Agency (CRA) relating to the Downtown Orlando Transit Circulator Expansion Alternatives Analysis (AA) Study; the Creative Village Moving Parramore Forward Project (Parramore BRT Project); and the Downtown Orlando East/West Bus Rapid Transit New Starts Project (New Starts Project), and authorization for the Chairman and Executive Director of the CRA to execute same, subject to review and approval of the City Attorney's Office, and authorization for the City Attorney's Office to correct any Scrivener's Errors.
